Introduction

JourneyPure (referred to herein as “JourneyPure,” “we,” “us,” and “our”) is committed to protecting the privacy and security of the information we collect, use, share, and otherwise process as part of our operations. We also believe in transparency, and we are committed to informing you about how we treat your information.

Our "Notice of Privacy Practices" (https://journeypure.com/privacy-policy/) describes how Protected Health Information (PHI) about you may be used and disclosed and the rights you have regarding that information. This Policy serves a different purpose, and it applies to information that is not PHI, which we may collect when you when you use JourneyPure Express (the “App”). This Policy does not apply to PHI.

PLEASE READ THIS PRIVACY POLICY CAREFULLY TO UNDERSTAND HOW WE TREAT YOUR INFORMATION AND WHAT CHOICES AND RIGHTS YOU HAVE IN THIS REGARD. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS POLICY, YOU SHOULD NOT USE THE APP.

THIS APP IS INTENDED FOR USERS LOCATED IN THE UNITED STATES, AND IT IS NOT INTENDED FOR USERS LOCATED IN OTHER COUNTRIES, INCLUDING THE EUROPEAN UNION AND THE EUROPEAN ECONOMIC AREA. BY USING THIS APP, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE USING THE APP FROM WITHIN THE UNITED STATES.

What Information Do We Collect?

We collect and use the following information from you for the purposes set forth in the “How Do We Use Your Information” section of this Policy. We may also share this information as set forth in the “How Do We Share Information” section below. However, any information that is PHI is governed by our Notice of Privacy Practices (https://journeypure.com/privacy-policy/) and is not subject to the Policy.

Contact Information When you use the App, we may ask you for your name, telephone number, email address, or other contact details. Depending on the context in which we collect this information, this information may be PHI.
Business Information When you register your facility for an account in the App, we collect your facility name, phone number, and address. We also collect the name of the individuals creating the registration and establishing accounts. We will share the list of registered facilities and users on the log-in page.
User Account Information In order to access and use the App, you must first complete a registration. When you create an account with us, we collect (1) your name, (2) your address; (3) your organization’s name, as applicable; and (4) your username and password. You may update your account information by editing it in the App.
Technical Data When you use the App, we automatically collect information from your mobile device, which may include: the date and time of your access, your device identifier, your mobile device’s SIM serial number, your device type, your operating system, your connection type (e.g., cellular or WiFi), data about which features you use, your user preferences, a push notification token, and information about your interaction with the App.
Device Permissions Push Notifications. When you use the App, you may grant us permission to send you push notifications on your device. You may at any time opt-out of receiving these types of communications by changing the settings on your mobile device.

Device access permission requests are limited to the information necessary to implement the App. You may opt-out of access and device access permissions by changing the settings on your device. Opting-out will cause the associated features to be disabled in the App.

How Do We Use Share and Disclose Your Information?

Subsidiaries and Acquisitions We may share your information with our corporate subsidiaries and affiliates and with their respective officers, directors, employees, accountants, attorneys, and agents. In addition, we may disclose your information in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our company assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by us about the App’s users is among the assets transferred. For example, if another company acquires us, we will share your information with that company.
Disclosures With Your Consent We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Policy. We will only disclose your information in this context with your consent.
Disclosures Without Your Consent We may disclose your information in response to subpoenas, warrants, court orders or other legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our legal rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property or a violation of our Terms of Use (https://journeypure.com/terms-of-use/).
Service Providers We may share your information with our service providers that need access to your information to provide operational or other support services on our behalf. Among other things, service providers may help us to administer the App; support our provision of services requested by you; provide technical support; send marketing, promotions and communications to you about our services; and assist with other legitimate purposes permitted by law.

How Long Do We Store Your Information?

Our Notice of Privacy Practices describes how we maintain PHI. Where the information is not PHI, we will retain and use your information for as long as is necessary to (1) fulfill the purposes for which it was collected, (2) comply with our business requirements and legal obligations, (3) resolve disputes, (4) protect our assets, (5) provide our services, and (6) enforce our agreements.

How Do We Protect Your Information?

We have put some security measures in place to protect the information that you share with us from being accidentally lost, used, altered, or disclosed or accessed in an unauthorized manner. In particular, the App uses a token-based system to identify a user. Once authenticated, a unique security token is created, which is subsequently used with all data transfers and stored with all local data. Data transfers between the App and our database (via the synchronization process) are always encrypted using a 256-bit TLS certificate. The security token contained in the data is further encrypted using a 128-bit AES cypher. From time to time, we review our security procedures to consider appropriate new technology and methods.

However, no security system is perfect, and no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from the App, and you do so at your own risk. We cannot promise that your information will remain absolutely secure in all circumstances.

If a data breach compromises your information, we will notify you and any applicable regulator when we are required to do so by applicable law.

Rights and Choices About Your Information?

Our Notice of Privacy Practices describes your rights with respect to any PHI we may maintain about you. If you would like to manage, change, limit, or delete other information or if you no longer want to receive any email, postal mail, or telephone contact from us in the future, such requests may be submitted via the Contact Information details at the end of this Policy.

Email Opt-Out. If you no longer wish to receive communications from us via email, you may opt-out by clicking the “unsubscribe” link available at the bottom of our email communications or by contacting us at privacy@journeypure.com and providing your name and email address so that we may identify you in the opt-out process. Once we receive your instruction, we will promptly take corrective action.

Accuracy and Updating Your Information. Our goal is to keep your information accurate, current, and complete. If any of the information you have provided to us changes, please let us know via “Contact Information” details provided at the end of this Policy. For instance, if your email address changes, you may wish to let us know so that we can communicate with you. If you become aware of inaccurate information about you, you may want to update your information. We are not responsible for any losses arising from any inaccurate, inauthentic, deficient, or incomplete information that you provide to us.

Complaints. If you believe that your rights relating to your information have been violated, you may lodge a complaint with us by contacting us using the information provided in the “Contact Information” section of this Policy.

No Disclosure of Your Information for Third-Party Advertising. We do not share your information with unaffiliated third parties for promotional purposes.

Third-Party Sites

This Policy is applicable only to the App, and it does not apply to any third-party websites.

The App may contain links to, and media and other content from, third-party websites. These links are to external websites and third parties with which we may have no relationship. Because of the dynamic media capabilities of the App, it may not be clear to you which links are to the App and which are to external, third-party websites. If you click on an embedded third-party link, you will be redirected away from the App to the external third-party website.

We cannot and do not (1) guarantee the adequacy of the privacy and security practices employed by or the content and media provided by any third parties or their websites, (2) control third parties’ independent collection or use or your information, or (3) endorse any third-party information, products, services, or websites that may be reached through embedded links on the App.

Any information provided by you or automatically collected from you by a third party will be governed by that party’s privacy policy and terms of use. If you are unsure whether a website is controlled, affiliated, or managed by us, you should review the privacy policy and practices applicable to each linked website.

Children's Online Privacy Protection Act Compliance

The Children’s Online Privacy Protection Act (“COPPA”), as well as other data privacy regulations, restrict the collection, use, or disclosure of personal information from and about children on the Internet. The App and our services are not directed to children aged 16 or younger, nor is information knowingly collected from children under the age of 16. No one under the age of 16 may access, browse, or use the App or provide any information to or on the App. If you are under 16, please do not use or provide any information on the App (including, for example, your name, telephone number, email address, or username). If we learn that we have collected or received personal information from a child under the age of 16 without a parent’s or legal guardian’s consent, we will take steps to stop collecting that information and delete it. If you believe we might have any information from or about a child under the age of 16, please contact us using the contact information provided below.

Updates and Changes to this Policy

We reserve the right, at any time and without notice, to add to, change, update, or modify this Policy to reflect any changes to the way in which we treat your information or in response to changes in law. Should this Policy change, we will post all changes we make to this Policy on this page. If we make material changes to how we treat your information, we will also notify you through a notice on the home page of the App for a reasonable period of time. Any such changes, updates, or modifications shall be effective immediately upon posting on the Site. The date on which this policy was last modified is identified at the beginning of this Policy.

You are expected to, and you acknowledge and agree that it is your responsibility to, carefully review this Policy prior to using the App, and from time to time, so that you are aware of any changes. Your continued use of the App after the “Last Updated” date will constitute your acceptance of and agreement to such changes and to our collection and sharing of your information according to the terms of the then-current Policy. If you do not agree with this Policy and our practices, do not access, view, or use any part of the App.
